Background of the study
Indigenous dispute resolution mechanisms have long been integral to maintaining social harmony within traditional communities. In Plateau State, these mechanisms—rooted in local customs, cultural norms, and community leadership—offer alternative approaches to conflict resolution that emphasize reconciliation and restorative justice (Afolabi, 2023). In contemporary societies, where formal legal systems may be inaccessible or mistrusted by certain communities, indigenous dispute resolution provides an essential avenue for resolving conflicts in a manner that respects local traditions and fosters community unity. Despite modernization, these mechanisms continue to be relevant, offering solutions that are cost-effective and culturally resonant. However, their integration with formal legal frameworks poses challenges and raises questions about their adaptability and effectiveness in the modern context. This study examines the role of indigenous dispute resolution mechanisms in Plateau State, assessing their impact on social cohesion and exploring ways to enhance their relevance in contemporary dispute resolution (Ibrahim, 2024).
Statement of the problem
Although indigenous dispute resolution mechanisms remain important in Plateau State, their effectiveness in modern society is challenged by increasing legal complexities and the influence of formal judicial systems. Traditional methods often face skepticism regarding their fairness and consistency, particularly when resolving disputes involving diverse social groups. Furthermore, the lack of official recognition and integration with modern legal processes limits their applicability and sustainability. This study seeks to address these challenges by evaluating the current state of indigenous dispute resolution and proposing strategies to harmonize traditional practices with contemporary legal requirements (Afolabi, 2023).
